Copyright Policy

Exploring Intellect (EX:I), as a Service and platform, aims to ensure that its Members
comply with the Copyright Act (No 98 of 1978) of South Africa and that there is respect for
the intellectual property rights of all people. As a result, this EX:I Copyright Policy outlines
the process of submission for notices of copyright infringements by its Members and the
resolution thereof.

For Members:

As per the EX:I User Agreement, Members are required to make sure that they post
information that is accurate, lawful and with due credit to the owners of the intellectual
property, and does not violate the intellectual property rights of any person or entity in any
form. In instances where this requirement has not been met, EX:I reserves the right to
disable access to or remove content with or without written notification to the Member
against whom a complaint of copyright infringement has been made. Furthermore, EX:I
reserves the right to disable and/or terminate, at its discretion, the accounts of individual
Members or groups of Members who post unlawful content or who infringe or repeatedly
infringe upon the intellectual property rights of others.

Submission for Notices/Complaints

In a case where there is an alleged copyright infringement, a written notice or complaint
should be submitted to EX:I. It is important to note, however, that any counter-notice or
notice submitted to EX:I should be truthful in order to warrant action against the accused
Member by EX:I. In addition, a false notice or counter-notice may give rise to legal action
by the offended party as per the Copyright Act (No 98 of 1978) of South Africa. As a result,
it is advisable to seek legal counsel before submitting a notice or a counter-notice.

The written notice/complaint submitted to EX:I should comprise of the following
information:

–  A description of the copyrighted work that is claimed to be infringed
–  A description specifying the location on our website of the material that is claimed to
be an infringement
–  Contact details including an email address, mailing address and/or a telephone or
mobile number of the copyright owner or elected representative(s)
–  A statement confirming, in good faith, that the use of the copyright material is/was
not authorized by the copyright owner, the elected representative(s), or the law
–  A statement confirming that the information in the notice is accurate and that the
person making said notice is the copyright owner or a representative authorized to
act on the copyright owner’s behalf
–  An electronic or physical signature of the copyright owner or the representative
authorized to act on behalf of the copyright owner
